TERMS AND CONDITIONS

Plant Purchases

1. Payment

Full payment must be received, or proof of payment sent, before we will send out your plants.  Payment is by Internet Banking. Customers with accounts must pay by the 20th of the month following invoice to prevent interest and other costs being charged. Interest may be charged up to 5% per month on overdue balance.
Pursuant to the Fair Trading Act 1986, we reserve the right to pass on all costs, disbursements or charges in the collection of overdue amounts.

2. Delivery

Plants will be freighted on the Monday or Tuesday following receipt of payment of invoice, unless other arrangements have been negotiated to send at a different time.

On delivery please inspect the goods carefully to check plants are all present and correct.  If you think some plants are missing, or you are not happy with your plants for some other reason please contact us by phone or email within 24 hours of receipt of the plants to advise us why. Please send photographs of the plants to help us deal with the issue.

Important – please note:  We are unable to accept liability for plants damaged in transit.  We pack and label our plants very carefully and do a ‘shake test’ before they leave us to ensure there is no movement in the box. However we cannot vouch for how a particular courier driver handles the boxes. Mishaps are rare, luckily, but do occur on occasion. We ask for your understanding that we are not able to make claims from the courier as the plants are classed as perishable.We do want our customers to be happy, so if your plants should arrive in a condition where they are damaged beyond repair we will do our best to come to a mutually satisfactory arrangement, but we cannot make any guarantees. Please ensure you send photographs of the plants to help us deal with the issue.

We anticipate that all deliveries will arrive as specified, however Kahikatea Farm cannot accept any liability for any delayed or lost deliveries.

3. Website images

All images of products are purely for illustration only. Kahikatea Farm cannot accept responsibility for any difference between the image on the website and the actual appearance of the product.

4. Disclaimer

Although many plants on this website are listed as edible, by purchasing the plant you assume all responsibility for any ill effects on yourself or your animals from eating these products. People can react in various and unpredictable ways to what they ingest and Kahikatea Farm cannot accept any liability for any adverse reactions to the plants. Nor do we assume any liability for adverse skin conditions or other reactions to a plant. We have a passion for growing herbs but we are not qualified herbalists and have no medical background. We always recommend that you consult with a qualified health-care practitioner before using herbal products, particularly if you are pregnant, nursing or on any medications. Kahikatea Farm cannot take any responsibility for any adverse effects from the medicinal use of the plants purchased from us or a plant not having the effect it is reputed to have. Nor does Kahikatea Farm accept any liability from adverse effects caused by the application of the information on this site, whether directly from our plants or others.

Courses and Tours  – Cancellation policy

Courses: If you have to cancel a course or workshop place more than 2 weeks before the start date we will give you a full refund minus a $10 admin fee. If you cancel your place within 2 weeks of the start date no refunds will be given but a course place may be taken up in the future on the same or other course or workshop, or you may transfer the place to a friend. We reserve the right to cancel a course if there are not enough registrations. A full refund will of course be given.

Tours: If you have to cancel a tour place more than 2 weeks before the start date we will give you a full refund minus a $10 admin fee. If you cancel your place within 2 weeks of the start date no refunds will be given but a tour place may be taken up in the future, or you may transfer the place to a friend. We reserve the right to cancel a tour if there are not enough registrations. A full refund will of course be given.

PRIVACY AND SECURITY

When you register and use this site you will be asked to provide certain information such as your contact details. We will store this data and hold it on computers or otherwise. We will use this data to fulfil our agreement with you. Kahikatea Farm takes the privacy of their customers very seriously. All information provided by you is kept confidential, and is never given to anyone else unrelated to the processing of your order. Third parties who may have access to your information may include courier services who will use this information to deliver your goods.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

Analytics

Who we share your data with/How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website, we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
